General Terms & Conditions (Full Version)

I. General Terms

  1. The following Terms and Conditions apply to the business relationship between clients (referred to as “Client” or “Participant”) and Heart & Mind Journey, Kathrin Preißner, Ludwigstraße 8, 82433 Bad Kohlgrub (referred to as “Provider” or “Organizer”).

  2. All coaching sessions, systemic constellations, workshops, and retreats offered by Kathrin Preißner are subject exclusively to these Terms and Conditions. By confirming a booking in writing, the Client accepts these conditions. These T&Cs are part of every contract concluded with Kathrin Preißner regarding the services offered. Any differing terms and conditions from the Client are not valid unless explicitly accepted in writing by Kathrin Preißner.​ 

  3. These Terms and Conditions are binding unless otherwise agreed individually. They apply regardless of whether Kathrin Preißner enters into the agreement on her own behalf, on behalf of others, or for third parties. They form the framework of the professional relationship between the parties and also apply to any supplementary or additional agreements beyond the main contract – including ongoing contracts previously agreed.

  4. To maintain the purpose of this agreement, Kathrin Preißner reserves the right to amend these Terms and Conditions where legitimate interests prevail (e.g. legal changes, court decisions, or economic shifts), provided such changes are reasonable for the Client. Clients will be informed of any changes and given a fair window to object. If no objection is made within the specified time, the new terms become valid.

  5. The Client may be a private individual or a legal entity. If another person or group is assigned to take part in the offered service, the original Client remains the contractual partner and bears full responsibility for the behavior of the Participants – unless a separate agreement is made directly with the Participant.

  6. Kathrin Preißner may perform the services herself or involve qualified cooperation partners, external experts, freelance staff, or assistants.

  7. All services offered are part of a process that takes trust and time.

  8. Kathrin Preißner’s services are aimed at individuals who are willing to invest time and trust, take responsibility for themselves and their actions, and explore new perspectives and behaviors.

  9. The Client confirms to be at least 18 years of age at the time the contract is concluded.

  10. The Client confirms that they are in the physical and mental condition necessary to participate in coaching, systemic constellations, workshops, and retreats.

  11. The aim of the coach-client relationship is to provide agreed-upon services – not to guarantee specific results. In particular, Kathrin Preißner does not guarantee any economic or health-related outcome. Statements and recommendations are intended to support personal development and do not replace medical, psychotherapeutic, or other therapeutic treatment.

  12. Services are based on the information provided by the Client. The accuracy and completeness of this information is the responsibility of the Client.

  13. For online sessions, the Client/Participant is responsible for ensuring they have suitable technical conditions (e.g. stable internet, updated browser). Kathrin Preißner is not liable for technical failures during sessions. In such cases, payment obligations still apply.

  14. Clients/Participants agree not to record any video, audio, or photographic material during sessions.

II. Subject Matter of the Contract – Coaching

  1. The aim of the coaching is to assess, work through and improve the client's current personal situation, taking individual aspects into account.
     

  2. For 1:1 coaching sessions, specific topics, service descriptions, procedures, and schedules are agreed upon during the introductory meeting, which takes place online. These will then be put into writing in an offer and become part of these General Terms and Conditions.
     

  3. The introductory meeting also includes the scope of the coaching, rules of conduct, and any further agreements regarding the approach and extent of the collaboration.
     

  4. An introductory meeting can be requested via the registration form at www.kathrinpreissner.com, by email at mail@kathrinpreissner.com, via the scheduling tool Calendly (https://calendly.com/mail-kathrinpreissner), or by phone at +49 171 4148853 (Mon–Fri, 10 am to 6 pm).
     

  5. The introductory meeting lasts approximately 30–45 minutes.
     

  6. The introductory meeting is free of charge.
     

  7. Unless other individual agreements have been made between the parties, all agreements between the parties result from these General Terms and Conditions, the order confirmation, and the declaration of acceptance.
     

  8. Coaching can be conducted either in person or online. The method of delivery is determined jointly by the parties.
     

  9. The contract is regularly concluded by written confirmation (email is sufficient) by the client.

III. Subject Matter of the Contract – Systemic Constellation Work

  1. Unless other individual agreements have been made between the parties, all agreements between the parties result from these General Terms and Conditions, the order confirmation, and the declaration of acceptance.
     

  2. Systemic constellation work can be conducted either in person or online. The method of delivery is determined jointly by the parties.
     

  3. The contract is regularly concluded by written confirmation (email is sufficient) by the client.
     

  4. The client must be aware that systemic constellation work is not a substitute for treatment by a medical doctor, psychotherapist, or alternative practitioner. The service provider does not make diagnoses. The client is solely responsible for their own healing.

IV. Heart & Mind Journey Workshops

  1. Kathrin Preißner’s range of services also includes the organization of events/workshops. Detailed information on each event, particularly regarding scope of services, price, and booking deadlines, is available on the website (https://www.kathrinpreissner.com).
     

  2. Interested individuals can purchase a ticket for a Heart & Mind Journey event/workshop via the platform “Eventbrite.”
     

  3. A contract between Kathrin Preißner and the interested party for participation in the event/workshop is formed once Kathrin Preißner confirms the booking in written or text form. If booking is done via “Eventbrite,” the terms and conditions of “Eventbrite” also apply.
     

  4. Kathrin Preißner sets a minimum and maximum number of participants for all events. If more bookings are made than spots available, Kathrin Preißner will decide on participation at her reasonable discretion.
     

  5. Events/workshops are offered both in-person and online.
     

  6. Ticket sales are handled by the external provider “Eventbrite.”
     

  7. Any advertised discounts are based on the specific offers.
     

  8. The decisive factor for a discount is the completed submission of data from the registration form to the provider or the receipt of the relevant email.
     

  9. Combining multiple discount offers is not possible.
     

  10. The participation fee only includes the personal attendance of the interested party or other individuals booked by them, unless stated otherwise.
     

  11. Travel and accommodation are not included in the services.
     

  12. In case of cancellation by the interested party, a refund of booked tickets may be possible under certain conditions. Missed or cancelled events by Kathrin Preißner cannot be rescheduled.
     

  13. Subject to availability and at her discretion, Kathrin Preißner allows substitute participants to attend without additional charges. The interested party must name any substitute participant in text form immediately, but no later than 8 days before the event. Kathrin Preißner will inform the interested party no later than 4 days before the event whether the substitute can attend.
     

  14. Kathrin Preißner reserves the right to cancel events/workshops at short notice if legal regulations prohibit holding the event, if the minimum number of participants is not reached, or due to illness, weather conditions, or other unforeseeable reasons. If Kathrin Preißner cancels the event herself, all payments made will be refunded in full.
     

V. Subject Matter of the Contract – Retreats

  1. Participation Requirements
    The participant confirms that they are at least 18 years old at the time of contract conclusion and in suitable mental and physical condition to attend a retreat.

     

  2. Booking Confirmation and Payment
    A binding booking is made upon written confirmation (via email).

     

  3. Cancellation Policy
    By the Participant
    Up to 12 weeks before the retreat: full refund minus a €50 processing fee.
    12 to 8 weeks before the retreat: 50% refund.
    8 to 4 weeks before the retreat: 30% refund.
    4 to 0 weeks before the retreat: no refund.

    It is generally possible to designate a substitute person by prior arrangement with Kathrin Preißner.

    Participants are strongly advised to take out travel cancellation and international health insurance.

    By the Organizer
    Retreats require a minimum of 6 participants to take place.

    The current pandemic regulations of the respective country apply. If the retreat cannot take place due to legal reasons, illness, or force majeure, the retreat fee will be refunded minus a €50 processing fee. This fee covers incurred costs.

    Kathrin Preißner is not liable for travel-related expenses or loss of work due to retreat preparation.

    Should the retreat be cancelled due to illness of the organizer or involved persons, insufficient participants, or other serious personal reasons, the full retreat fee will be refunded without the processing fee.

    Please note: The organizer assumes no liability for any cancellation costs related to travel or external services.
     

  4. Changes by the Organizer
    The organizer reserves the right to make changes to the retreat program. Participants will be informed of any necessary changes due to illness or unforeseen events (e.g. force majeure).
     

  5. Limitation of Liability
    Each participant must be able to present valid liability insurance upon request. The organizer is not liable for health, personal, or material damages not caused by her, whether during travel or the retreat. No liability is accepted for self-inflicted damages or lost/damaged valuables.

     

  6. Self-Responsibility
    Participants are responsible for considering their own physical and mental limitations and for attending to their own needs. By participating, they agree to take full responsibility during the execution of exercises and tools.

     

  7. Data Protection
    By making payment, participants consent to their provided data being used for communication and future offers via email by Heart & Mind Journey. Data will not be shared with third parties. Consent can be withdrawn at any time via email.

     

  8. Arrival/Departure
    Participants are responsible for timely arrival. The organizer cannot be held responsible for delays.
    Participants must inform the organizer in time of any changes to arrival schedules.

     

  9. Requests, Complaints, Suggestions
    Participants agree to address any complaints, suggestions, or wishes promptly with the organizer or her team.

     

  10. Board and Lodging Cancellation Policy
    The cancellation policy of the board and lodging provider (e.g., Hubrid or Hide Out Stays) applies independently of Kathrin Preißner’s cancellation policy. 

  11. Miscellaneous
    Participants agree to behave respectfully at the venue and handle equipment and accommodation appropriately.
    Misconduct may result in exclusion from the retreat and early departure at the participant’s own expense, without a refund.
    Disruptive participants may be excluded after a warning.
    Smoking is prohibited indoors. Alcohol and illegal drugs are not allowed during the retreat. (A designated smoking area is available outside.)

     

VI. Compensation

  1. The amount of compensation for 1:1 coaching | systemic constellation work | group programs | workshops | retreats is determined individually as a flat fee and depends on the respective individual scope. The individual compensation arrangements will then be summarized in the offer.
     

  2. Compensation is generally paid in a single payment of the full amount.
     

  3. In specified cases, the compensation may be paid in installments by prior agreement.
     

  4. Payment is to be made by bank transfer to the contractor’s account following proper invoicing. The payment terms and bank details are specified on the invoice.
     

  5. The prices stated are gross amounts including the legally applicable VAT.
    Should any travel expenses be incurred by the contractor, the parties will mutually agree on the assumption of the costs.

VII. Cancellations

The following regulations apply to individual coaching sessions and systemic constellation work. For events, workshops, and retreats, different or additional provisions apply, which are stated separately in each case.

Previously agreed individual appointments must be kept punctually and can be rescheduled only once (the latest by the evening before the scheduled appointment). Otherwise, the full fee is due unless the appointment can be reassigned. The agreed time must be adhered to; if the client is late, the duration of the session will be shortened accordingly.

VIII. Copyright

All documents handed over to clients are included in the agreed fee, unless otherwise stated.

The copyright to all materials, texts, recordings, and audios belongs solely to Kathrin Preißner. Clients are not permitted to reproduce and/or make these documents, texts, recordings, and audios available to third parties, in whole or in part, without written permission from Kathrin Preißner.

IX. Confidentiality

  1. The Heart & Mind Journey offerings provide a protected space for participants. Participants agree to treat topics discussed in connection with the names of other participants as confidential.
     

  2. Publishing topics in connection with participant names is prohibited and will result in exclusion from events/workshops/retreats.
     

  3. In the context of 1:1 coaching and systemic constellation work, both the contractor and the client/participants agree to maintain confidentiality regarding all information received under this agreement. This includes all content and materials created or shared, including copies and reproductions, and applies to both physical and electronic data. This obligation continues after the agreement ends, until the information becomes publicly known.
     

  4. This obligation does not apply to information for which the respective party can prove:
    a. The information was publicly known at the time of disclosure and not due to a breach by the party.
    b. The information was lawfully obtained by other means without violating confidentiality obligations.
    c. The information must be disclosed due to legal or official requirements, provided the other party is informed in advance and reasonable steps are taken to minimize the disclosure.

     

X. Liability and Warranty

  1. The client is fully liable for any damages caused to the provided premises before, during, or after coaching, constellation work, events, workshops, or retreats.
     

  2. Warranty claims are governed by statutory provisions unless otherwise limited by the following clauses.
     

  3. Warranty claims expire after one year from the statutory commencement date.
     

  4. The contractor commits to performing all agreed services diligently and to the best of their knowledge.
     

  5. There is no guarantee of success in the provision of services. Liability is excluded.
     

  6. Clients/participants have no general right to claim damages.
     

  7. This limitation of liability does not apply to damages resulting from injury to life, body, or health due to intentional or negligent breaches of duty, or to damages from the breach of essential contractual obligations or from gross negligence by the contractor or her agents/legal representatives. In such cases, liability is limited to foreseeable and typical damages.
     

  8. Each client is fully responsible for themselves and their actions during and outside of sessions, events, or retreats, and is liable for any damages caused. No liability is accepted for accidents, injuries, or theft. Instructions given by the consultant must be followed; failure to do so releases Kathrin Preißner from any liability.
     

  9. Workshops, retreats, and consultations are for informational purposes only and do not replace advice from a doctor, pharmacist, or alternative practitioner. Any reference to healing effects is purely informational. No guarantee or liability is assumed for mentioned or learned applications. For personal use, consultation with a medical professional is strongly recommended.
     

  10. Travel to and from the venue is at the client’s own responsibility. Kathrin Preißner assumes no liability.
     

XI. Data Protection

  1. The contractor collects and processes personal data received from the client as part of this contractual relationship.
     

  2. Data collection and processing are for the purpose of fulfilling the contract, based on Art. 6(1)(b) GDPR.
     

  3. Additional purposes of data processing may arise from legal obligations (e.g., recordkeeping duties), based on Art. 6(1)(c) GDPR.
     

  4. Data processing may also be based on legitimate interests of the contractor or third parties, provided the client's rights and freedoms are not overridden (e.g., for long-term archiving of work), based on Art. 6(1)(f) GDPR.

XII. Final Provisions

  1. If any provision of this agreement is or becomes invalid or unenforceable, the remaining provisions shall remain effective.
     

  2. The invalid or unenforceable provision shall be replaced by a valid and enforceable one that best reflects the original intent.
     

  3. Individual agreements to amend or supplement this contract are valid without form. Otherwise, amendments or supplements require written form. The burden of proof lies with the party claiming a deviation from written form.
     

  4. Place of jurisdiction is Garmisch-Partenkirchen.
     

  5. German law exclusively applies to the entire contractual relationship between Kathrin Preißner and the client/participant.
     

XIII. Right of Withdrawal

 

If you are a consumer, you have the right to withdraw from this contract in writing (email is sufficient) within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.

Right of Withdrawal

 

To exercise your right of withdrawal, you must inform me (Heart & Mind Journey, Kathrin Preißner, Ludwigstraße 8, 82433 Bad Kohlgrub, mail@kathrinpreissner.com) by means of a clear declaration (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient to send your communication before the period expires.

Consequences of Withdrawal

If you withdraw from this contract, I will refund all payments received from you, including delivery costs (except additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered), immediately and at the latest within fourteen days of receiving your notice of withdrawal. The same payment method used in the original transaction will be used unless otherwise agreed. You will not be charged any fees for the refund.

I may withhold the refund until I have received the goods back or you have provided proof of return, whichever is earlier.

You must return or hand over the goods promptly and at the latest within fourteen days from the day you notify me of your withdrawal. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods if it results from handling beyond what is necessary to establish their nature, characteristics, and functioning.
